Section 02

Accepting these terms

These Terms apply to all individual consumers who use the Vestyl Service. By actively creating an account and clicking "I agree" during account registration, you confirm that:

• You have read and understood these Terms
• You are at least 18 years old
• You have the legal capacity to enter into a binding agreement
• You agree to comply with these Terms at all times

Section 03

Eligibility and age

You must be at least 18 years old to use Vestyl. This applies to all parts of the Service, including the AI try-on feature which involves the upload and processing of personal photographs containing biometric data.

We do not knowingly permit anyone under the age of 18 to create an account. If we discover that a user is under 18, we will immediately suspend their account and delete all associated data.

If you are a parent or guardian who believes your child has created an account, please contact us immediately at hello@vestyl.app.

Section 04

Your account

Creating an account

To access most features of Vestyl you will need to create an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.

Account security

You are responsible for taking reasonable steps to maintain the confidentiality of your account credentials. You must notify us immediately at hello@vestyl.app if you become aware of any unauthorised access to your account.

One account per person

You may only create one Vestyl account. Where we identify multiple accounts held by the same person, we will notify you and give you a reasonable opportunity to consolidate before taking action.

Deleting your account

You may delete your account at any time via Settings → Account → Delete my account. Your account and all associated data will be permanently removed within one calendar month, in line with our obligations under UK GDPR.

Section 05

The Vestyl service

What Vestyl provides

• A catalogue of clothing items from partner brands that you can browse
• An AI-powered virtual try-on feature that generates an image of you wearing selected items
• A social feed where you can share try-on images and receive community feedback
• Links to purchase items through partner retailers via affiliate links

What Vestyl does not provide

Vestyl is not a retailer. When you click to purchase an item, you are directed to the partner retailer's own website, and your purchase is made directly with that retailer under their terms. Disputes about purchases should be directed to the relevant retailer.

Changes to the service

Where we make changes that materially and adversely affect your use of the Service, we will provide at least 30 days' advance notice by email and in-app notification before those changes take effect.

Section 06

AI try-on and your photo

How the try-on feature works

When you use the try-on feature, your photo is transmitted via a secure API connection to FASHN AI (FASHN LTD, 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ). FASHN AI processes your photo alongside the selected clothing item to generate a virtual try-on image, which is then returned to and displayed in the Vestyl app.

FASHN AI is an independent third-party service

FASHN AI operates under its own privacy policy and terms of use. We strongly encourage you to read their Terms of Use and Privacy Policy before uploading any photograph.

FASHN AI's use of your photo — important disclosure

Under FASHN AI's current Terms of Use, by submitting images to their service, users grant FASHN AI a licence to use, copy, modify, and process those inputs for the purpose of improving and operating their services. This means a photograph you submit via Vestyl may potentially be used by FASHN AI to improve their AI systems.

What you must not upload

• Photographs of any other person without their explicit, informed consent
• Photographs of anyone under the age of 18
• Images that are intimate, sexual, or offensive in nature
• Images that you do not have the legal right to use

Non-consensual intimate images — criminal offence

It is a criminal offence under the Online Safety Act 2023 to share, and under amendments to the Sexual Offences Act 2003, to generate non-consensual intimate AI-generated images of any person. Vestyl operates a zero-tolerance policy. Any account found generating or sharing such content will be permanently banned and reported to law enforcement.

Section 07

Content you post

Your content, your responsibility

You are solely responsible for any content you post on Vestyl. By posting content, you confirm that you own it or have the right to post it, and that it complies with these Terms and all applicable laws.

Licence you grant to Vestyl

By posting User Content on Vestyl, you grant Vestyl a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute that content within the Vestyl app solely for the purpose of operating the Service. We will never sell your content to third parties or use it in advertising without your separate, explicit consent.

Content moderation

We actively moderate content and will remove anything that is illegal, constitutes non-consensual intimate imagery, is abusive or harassing, depicts or endangers minors, promotes self-harm, or is spam.

Response times for content reports

To report content, use the in-app report function or email hello@vestyl.app.

Section 08

Intellectual property

Vestyl's intellectual property

The Vestyl name, logo, app design, code, and all original content created by Vestyl are protected by copyright, trade mark, and other intellectual property laws. You may not use, copy, reproduce, or distribute any Vestyl intellectual property without our prior written consent.

AI-generated try-on images — your rights

Vestyl does not assert copyright ownership over AI-generated try-on images featuring your own likeness. You may save them to your device, share them on personal social media for non-commercial use, and post them within Vestyl's feed. You may not use them in paid advertising, sponsored content, or any paid commercial activity without Vestyl's prior written permission.

Feedback

If you provide Vestyl with feedback or ideas, you grant us a non-exclusive, royalty-free right to use that feedback to improve the Service. You will not receive compensation for feedback you provide.

Section 09

Affiliate links and purchases

Pricing and availability

Product prices and availability are provided by partner retailers and updated periodically. Prices may change between the time they are displayed in Vestyl and when you complete a purchase. Always confirm the final price on the retailer's website before purchasing.

Your purchase is with the retailer, not Vestyl

Vestyl is not a party to any purchase you make through an affiliate link. Vestyl is not responsible for product quality, delivery, refunds, returns, or any disputes between you and the retailer.

Section 10

Prohibited conduct

You must not use Vestyl to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of any person
• Upload photographs of other people without their explicit, informed consent
• Generate or distribute non-consensual intimate AI images
• Post abusive, threatening, harassing, or discriminatory content
• Impersonate any person or entity, including Vestyl staff or other users
• Post false, misleading, or deceptive content
• Use automated scripts, bots, or other tools to interact with the Service artificially
• Attempt to gain unauthorised access to any part of the Service or other users' accounts
• Scrape, reverse-engineer, or decompile any part of the Service
• Exploit or harm minors in any way

Section 11

Sanctions compliance

You may not use the Vestyl Service if you are located in, or acting on behalf of any person in, a jurisdiction subject to comprehensive UK, EU, or US economic sanctions — including Russia, Iran, North Korea, Belarus, Cuba, and Syria — or if you are individually designated on any applicable sanctions list.

Section 12

Cancellation and refunds

Free tier

The core Vestyl app is currently free to use. There is nothing to cancel and no charge to refund. You may stop using the Service and delete your account at any time.

Future paid features

Vestyl may introduce paid subscription features in the future. When any paid tier is introduced, you will have a 14-day right to cancel from the date of purchase, easy one-step cancellation in-app, and a 14-day pre-renewal reminder. Full pricing and cancellation details will be clearly provided before any paid feature is made available.

Your statutory rights

Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 or any other applicable legislation.

Section 13

Termination

Termination by you

You may stop using Vestyl and delete your account at any time, with no notice required.

Termination by Vestyl

We may suspend or terminate your account if you breach these Terms, engage in prohibited conduct, or where required by law. Where possible, we will give you at least 14 days' notice and a reasonable opportunity to respond. We may act without notice for serious breaches such as generating non-consensual intimate imagery or fraud.

Section 14

Liability and disclaimers

What we are responsible for

Vestyl is responsible for providing the Service with reasonable skill and care.

What we are not responsible for

To the fullest extent permitted by law, Vestyl is not liable for purchases through affiliate links, content posted by other users, the actions of FASHN AI as an independent third party, loss of profit or business, or any indirect or consequential loss.

Limits we cannot exclude

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded under consumer law.

AI-generated images — no warranty

AI-generated try-on images are simulations and may not accurately represent how a garment will look in reality. Purchase decisions should not be made solely on the basis of AI-generated imagery.

Section 15

Indemnification

You agree to indemnify Vestyl from claims arising out of your breach of these Terms, your violation of applicable law, content you post on Vestyl, or your misuse of the AI try-on feature. This clause only applies to losses directly caused by your breach and does not require you to indemnify Vestyl for losses caused by Vestyl's own acts or omissions.

Section 16

Force majeure

Vestyl will not be liable for any failure or delay resulting from circumstances beyond our reasonable control, including failure of third-party services (including FASHN AI), internet outages, acts of God, pandemic, government action, or cyberattacks despite reasonable security measures.

Section 17

Changes to these terms

For minor changes we will provide at least 14 days' notice. For material changes that adversely affect your rights we will provide at least 30 days' advance notice by email and in-app notification. If you do not agree with updated Terms, you should delete your account.

Section 18

Governing law and disputes

Governing law

These Terms are governed by the laws of England and Wales. This does not affect any mandatory consumer protection rights you have under the laws of your country of residence.

Resolving disputes

If you have a complaint, please contact us first at hello@vestyl.app. We commit to acknowledging your complaint within 5 working days. If a dispute cannot be resolved informally, both parties agree to submit to the jurisdiction of the courts of England and Wales.

Section 19

General provisions

Entire agreement

These Terms, together with our Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and Vestyl in relation to the Service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, it shall be modified to the minimum extent necessary or severed, and the remaining provisions shall continue in full force.

Assignment

You may not assign any of your rights under these Terms without Vestyl's prior written consent. Vestyl may assign these Terms to a successor entity in connection with a merger or acquisition, with reasonable notice to you.
